A Pay Less Notice is a notice giving the payer the right to pay less than the sum applied for or withhold all of it. A Pay Less Notice is distinct from a Payment Notice. The payer should issue a Pay Less Notice if they disagree with the sum claimed by the contractor. There is a due process to follow. Failure to serve a pay less notice will mean that the sum applied for or the certified sum must be paid.
