The general rule is the loser pays around 75% of the winner’s costs. However, in Small Claims you cannot usually recover costs unless you have a contractual right to recover the costs or the opponent has acted unreasonably. The same is true in relation to your liability to pay the opponent’s costs. Whether it is contractual costs or costs for unreasonable behaviour the court has discretion.
