In simple terms, we need to understand what has gone wrong, what has happened, and what loss has been suffered as a result. The detail and information/documents will vary but typically the best approach is for you to initially brief us in summary form via email, perhaps attaching any core documents such as a Shareholders agreement, if any.

We will then usually follow up via a call with a Partner. The direction at that stage can/will vary and will depend on the facts and circumstances. We might need to compile evidence with you such as in a witness statement, obtain information from you or third parties, or might immediately suggest issuing court proceedings to protect your position. Ultimately, to be successful in a claim for unfair prejudice, the petitioner must show that the actions of the Shareholder were both unfair and were prejudicial.
