Small Claims
Simple cases that do not involve exorbitant sums of money nor complex arguments or proceedings. Small claims are predominantly used so the claimant may receive compensation or have their money refunded if they feel they have been wrongfully charged. It is exceedingly rare that small claims exceed the threshold of £10,000.
Some examples of common small claims include:
Faulty products;
Poor service by a business or service;
The owing of a refund that has not been paid;
Disputes between landlords and tenants, primarily over rent or damaged property;
Accidents resulting in injury; and
Money owed for work completed.
Small claims are occasionally referred to as ‘money claims’. In most cases, claimants do not require a solicitor as they are relatively easy to resolve. Before filing for a small claim, it is recommended that alternative routes are exhausted beforehand. The most common way to achieve this is through formal mediation rather than involving the courts.
