Section 136 of the Law of Property Act 1925
28 February 2025
Section 136 of the Law of Property Act (LPA) 1925 provides a way to assign a debt and a chose in action using a legal or statutory assignment. A chose in action is simply a right to property or a right to possession.
S. 136 effectively allows a debtor to pay a different person or third party, called an assignee, nominated by the creditor, also known as the assignor.
It also protects the debtor from the assignor/creditor still trying to pursue the original debt against them because the assignor doesn’t accept the first payment to the assignee as a full settlement.
