Claim Form N1
In England and Wales, a Form N1 is used to initiate civil proceedings against an individual or organisation, such as claims for unpaid debts or breaches of contract. This is the correct claim form to use where there are disputed facts and law, and where what is known as a ‘Part 7’ claim is being issued. Where a claim relates to only issues of law a ‘Part 8’ claim might be more appropriate.
The claimant issuing the claim in court must complete the claim form document by providing details of the parties, their case, and its value. The Claimant must pay a fee when filing the N1 (or any claim), calculated based on the claim amount.
Legal proceedings commence once the court receives and issues the claim form, and also after it has been served. The court will either issue and serve the claim, or if the Claimant wants to serve and selects this option, after service has taken place.
