Setting Aside a Judgment

If the court issues a judgment against you without your knowledge, for example, because you did not receive the relevant papers, you can apply to set the order aside. To do this, you must apply to the Court using aForm N244 and provide reasons for not responding.

In your application, you must provide a valid reason for not responding to the original claim, such as not receiving the court papers. You should also include any evidence that supports your case, such as proof of your address at the time the papers were sent.

In the application, you must also demonstrate that you have a reasonable prospect of defending the claim. If the court agrees with your evidence, it will dismiss the previous judgment and set further directions to allow you to present your case.

You should file an N244 as soon as possible after being notified of the order against you, as any delay could negatively impact your chances of setting it aside.
