Can I Sue My Neighbour for Trespassing?
Typically, a neighbour should not enter your property without permission. Doing so can amount to trespass and lead to injunctions and damages being claimed against the trespasser. If access is being refused but is needed for ‘basic preservation works’, however, in England and Wales, the Access to Neighbouring Land Act 1992 provides a legal framework for a landowner to apply to the court for an order permitting access for that purpose, i.e., to carry out repairs to their home. If someone refuses access in this context, there is a risk of a court order being issued that permits access. You may be compelled to cover your neighbour’s costs in this scenario.
