If the claim form or particulars of claim are vague or confusing, or you think they contain an error, you can ask for clarification. This is a formal process and taking any steps carries an adverse costs risk; i.e. you might be ordered to pay the other sides costs if you take the wrong approach. Don’t guess. You’re entitled to request further information under Part 18 of the Civil Procedure Rules. This can help you understand what the claim is about and how best to respond but this has to be pursued in an appropriate way at the right time. For example consider whether you should be filing an acknowledgement of service to extend your response deadline by 14 days, seeking an extension of time or even applying to the court. Responding improperly or missing a deadline, even with unclear documents, can lead to a default judgment against you. If you are in this situation you should seek advice from a specialist litigation law firm.
