A Claim Has Been Issued Against Me, but I Have My Own Claim Against the Same People – What Should I Do About It?
If you have a valid claim against the claimant, you may be able to issue a counterclaim as part of your defence. This allows the court to deal with both claims together. You must raise this when filing your defence, so timing and accuracy are important. Counterclaims must be supported by evidence and follow proper procedure, and so whilst it is not technically a requirement, obtaining advice from a specialist litigation solicitor is best to help you assess whether a counterclaim is appropriate and how best to present it to the court.
